CFL Class Action Notice

Canadian Football League (“CFL”) Class Action discontinued and Former Players’ rights converted to arbitration.

To CFLAA Members on behalf of the CFLAA Board of Directors:

The CFLAA Board of Directors has unanimously agreed to distribute to CFLAA Members the following court-approved Legal Notice of Discontinuance of the CFL Class Action Lawsuit[AB1] . This distribution to CFLAA Members is done both neutrally and voluntarily.

The notice is not the CFLAA’s document; we have only been asked to help distribute it to former players in our membership. 

Below is an excerpt from the NOTICE OF DISCONTINUATION.  Please read the attached document for details, including contact information for the lawyers handling this.

YOU HAVE THE OPTION TO MAKE A CLAIM FOR CONCUSSION-RELATED INJURY THROUGH AN ARBITRATION PROCESS BY APRIL 30, 2024

The CFL Defendants (the league, its teams, and former commissioner Mark Cohon) have agreed to a labour arbitration process whereby Former Players alleging a concussion-related injury as of October 31, 2023, can seek to file a claim (known as a “Grievance” within the arbitration process). The arbitration process will be governed by the applicable CBA as follows:

  • For claims that arise pre-May 2019 the 2014-2019 CBA will apply; and
  • For claims that arise after May 2019, the subsequent CBA will apply.

The deadline for Former Players to file a grievance for known or suspected concussion-related injury impacts is April 30, 2024.

Former Players may contact the following sources for further information in respect of their options to file a grievance:

  • A group concussion-related grievance was filed by the CFL Player’s Association (“CFLPA”) on March 18, 2018 (the “Group Grievance”). Should you wish to speak with and/or be represented by the CFLPA, they may be able to represent you within this Group Grievance. You may contact the CFLPA at admin@cflpa.com. The CFLPA has advised that they will also consider requests for it to file individual grievances on behalf of individual members; OR
  • Robyn Wishart of Wishart Brian & Spine Law has also initiated grievances on behalf of Former Players. Ms. Wishart is a personal injury lawyer and was involved in the class action, as well as a parallel proceeding commenced in British Columbia by Mr. Arland Bruce.   • You may also retain your own lawyer to initiate a grievance on your behalf.
